This End User License Agreement ("EULA") is a legal agreement between you and Picomi concerning the Picomi mobile application made available through the Apple App Store. By downloading, installing, or using Picomi, you agree to be bound by this EULA and, where applicable, Apple's Licensed Application End User License Agreement.
If you do not agree to this EULA, do not download or use Picomi. Your continued use of the app constitutes acceptance of this EULA and any updates we publish.
Picomi is intended solely for users who are 18 years of age or older. By using the app, you represent and warrant that you are at least 18 years old. If you are under 18, you must not use Picomi.
Subject to your compliance with this EULA, Picomi grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app for personal, non-commercial purposes on Apple platforms that you own or control, as permitted by the App Store Terms of Service.
Picomi, including its software, design, trademarks, and related materials, remains the property of Picomi and its licensors. This EULA does not transfer ownership of any intellectual property to you. Photos and creations you make with the app remain yours, subject to any rights of third parties in source materials you provide.
We may provide updates, patches, or new versions of Picomi. Some updates may be required for continued use. Updates may modify or remove features. This EULA applies to all updates unless accompanied by a separate license.
Picomi may rely on services provided by Apple, including the App Store and Sign in with Apple. Your use of those services is also subject to Apple's applicable terms and policies.
To the maximum extent permitted by law, Picomi is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, Picomi and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the app. Our total liability for any claim arising from this EULA or the app shall not exceed the amount you paid to us (if any) for the app in the twelve months preceding the claim, except where such limitation is prohibited by law.
This license is effective until terminated. Your rights under this EULA terminate automatically if you fail to comply with any of its terms. You may terminate at any time by deleting the app and your account. Upon termination, you must cease all use of Picomi and delete all copies in your possession.
This EULA is governed by the laws applicable in your place of residence, without regard to conflict-of-law principles, except where Apple's App Store terms require otherwise. If any provision is found unenforceable, the remaining provisions will continue in full force and effect.
We may update this EULA from time to time. The "Last updated" date will change when we do. Continued use of Picomi after an update constitutes acceptance of the revised EULA.
